General terms and conditions

Concepts & Applicability

• These general terms and conditions apply to all offers, orders and agreements of SelectedBy. Unless SelectedBy agrees to other conditions in writing.
• You cannot derive any rights for future transactions from any agreed deviations.
• Accepting an offer and placing an order implies that you accept the applicability of these conditions.
  
  

• All prices listed on the SelectedBy website include 21% VAT. All items are shipped free of charge within the Netherlands for orders of €75 or more.
• If you order multiple items, the shipping costs and/or transaction costs remain the same.
• Until the agreement has been concluded, SelectedBy is authorized to change the prices and other conditions.
• Typing and printing errors reserved.

Deliveries

• All products will be shipped as soon as possible after payment. If you have any questions about the exact delivery time, please always contact us in advance to ask for the delivery time.
• If items have a longer delivery time or cannot be delivered (temporarily), you will normally be notified within 2 working days.
• We do everything we can to meet our promised delivery time. However, during busy times in the warehouse, at our suppliers or at PostNL, delays may occur.
• SelectedBy is not liable for any damage whatsoever resulting from exceeding the announced delivery times.
• SelectedBy takes the utmost care in receiving orders and sending ordered items. Nevertheless, it may happen that an order is not delivered or is incomplete. You must report this within 2 days of receiving the items. The delivery will then possibly be supplemented or redone.

Payment options

• The purchase and sale agreement is concluded at the moment that you accept the offer and meet the conditions set. As long as the receipt of this acceptance has not been confirmed by e-mail, the customer can terminate the agreement.
• The amount due can be paid via IDEAL, Visa, MasterCard, American Express, PayPal, UnionPay and bank transfer.
• When paying with Visa, MasterCard and American Express, SelectedBy reserves the right to check whether the card is valid, whether there is sufficient credit available to debit the purchase amount and whether your address details are correct.

Complaints & Returns

• We do everything we can to deliver you a great product. SelectedBy recommends that you inspect the delivered items immediately upon receipt. If the ordered items do not meet your expectations, please do not hesitate to inform us by e-mail. SelectedBy will always try to resolve any problems or complaints in consultation with you and in the best possible way.
• If SelectedBy has not received any written objections within 2 working days, SelectedBy will assume that it has fully met its obligations.
• As a consumer, you have the right to return the items delivered by SelectedBy within 14 days of receipt. During the 14-day inspection period, you must handle the items and packaging with care. You will only unpack or use the product to the extent necessary to assess whether you wish to keep the product. See also the page on returns in this context.
• It is not possible to return gift cards, vouchers or similar.
• The items can be returned within the inspection period if reasonably possible in the original packaging and in new condition, by sending the return form. You are responsible for paying the related shipping costs.
• If the items are unused and undamaged and have been returned on time and correctly, SelectedBy will refund the paid price excluding costs for a more expensive shipping method, no later than 14 days after receipt of the returned items. If a payment has been made with a gift card from SelectedBy and/or one of the partners, this amount will be paid out in a gift card from SelectedBy.
• If the items delivered by SelectedBy are not returned within 14 days of receipt, the items will be deemed to have been accepted by you.

Liability

• Any liability of SelectedBy, of the staff and the products of SelectedBy for all damage, of whatever nature, direct or indirect, is excluded from the moment the product is delivered to the customer. SelectedBy is also not liable for damage caused by third parties during the execution of the agreement.
• SelectedBy accepts no liability for any damage resulting from the use of SelectedBy products.
• SelectedBy's liability is always limited to a maximum of the purchase price of the relevant article.
• SelectedBy is not liable for any misunderstandings, mutilations, delays or improper receipt of orders and communications resulting from the use of the Internet or any other means of communication in the traffic between you and SelectedBy, or between SelectedBy and third parties, insofar as this relates to the relationship between you and SelectedBy, unless there is intent or gross negligence on the part of SelectedBy.

Force majeur

• In a situation of force majeure, the obligations of SelectedBy are suspended. If the period in which the force majeure occurs is longer than two months, both you and SelectedBy have the right to terminate the agreement without any obligation to pay damages. Force majeure occurs, among other things, in the event of strikes, disruptions, import/export bans, regardless of whether this occurs at SelectedBy or at SelectedBy's suppliers.

Privacy

• SelectedBy respects the privacy of all users of its site and ensures that the personal information you provide us with is treated confidentially. Your personal data is used to process the order.
• In addition to processing orders, the data will only be used after your permission – in short – for marketing purposes and maintaining customer relations.
• The data will never be made available to third parties, unless they are involved in processing your order.

Applicable law

• The agreement and these general terms and conditions are exclusively governed by Dutch law.
